Privacy Policy

Tenebr (“we”, “us”) runs a dating service at tenebr.app. This policy tells you what we collect, what we do with it, and your rights under the UK GDPR and the EU GDPR.

Who is the data controller?

The operator of Tenebr is the data controller. For rights requests, write to privacy@tenebr.app.

What we collect

By filling in your gender, trans status, or interested-in preferences, you are providing data that reveals information about your sexual orientation — a “special category” under GDPR. We process this only with your explicit consent, which you give by completing that section of your profile. You can revoke consent any time by deleting your account.

Advertising and ad tracking

Tenebr shows sponsored profile cards in the discovery feed. When you interact with one — or it appears on screen — we log the event type (impression, swipe right, swipe left, or message open) against your account. This data is used solely to generate anonymous aggregate statistics for advertisers. Advertisers receive breakdowns by gender, age range, and subculture interest. Your name, username, photos, and any individually identifying information are never shared with advertisers.

Legal basis (GDPR Art. 6(1)(f) — Legitimate Interests). We process ad interaction data on the basis of legitimate interests: enabling a free-to-use platform funded by advertising. We have assessed that this use does not override your rights, given that no identifying data reaches advertisers, tracking is limited to in-app interactions with content you encounter in normal use, and you can opt out at any time.

Opt-out. You may opt out of ad interaction tracking at any time in Settings → Privacy → Ad Personalisation. If you opt out, you will still see ads but your interactions will not be logged or reported to advertisers.

Who we share data with

We do not sell your data. We do not share personal data with ad networks or advertisers — only anonymous aggregate statistics.

Retention

Under UK/EU GDPR you can ask us to:

Email privacy@tenebr.app and we will respond within 30 days. If you are in the UK and think we have mishandled your data, you can complain to the Information Commissioner’s Office.

International transfers

Our infrastructure providers may process data in the EU, UK, and United States. Where data leaves the UK/EU we rely on the UK IDTA and EU Standard Contractual Clauses.

Cookies & local storage

We use cookies and browser local storage strictly to keep you signed in and remember your settings. No tracking or advertising cookies.

Children

Tenebr is 18+ only. We do not knowingly collect data from anyone under 18. If you believe a minor has created an account, email safety@tenebr.app immediately and we will remove the account.

Terms of Service

Please read these Terms carefully. They contain a binding arbitration clause and class action waiver (Section 20–21) that affect your legal rights. By using Tenebr you agree to resolve disputes individually through arbitration rather than in court or as part of a class.

These Terms of Service (“Terms”) constitute a legally binding agreement between you and the operator of Tenebr (“Tenebr”, “we”, “us”, “our”). By accessing or using Tenebr — whether via the website at tenebr.app, any mobile application, or any related service — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the service.

1. Eligibility and user representations

To use Tenebr you must:

By creating an account, you represent and warrant that all of the above are true and that all information you provide is accurate, current, and complete. If we discover that an account belongs to someone under 18, we will terminate it immediately and permanently delete all associated data without notice or compensation.

2. Account security and responsibility

You are solely responsible for all activity that occurs under your account, whether or not you authorised it. You must not share your magic-link sign-in emails with any third party. If you suspect unauthorised access, notify us immediately at safety@tenebr.app. Accounts are personal and non-transferable. We reserve the right to disable any account at any time at our sole discretion, including where we believe your account credentials have been compromised.

3. Platform status and user-generated content

Tenebr is an interactive computer service and a platform for user-generated content. We do not create, edit, or endorse any content posted by users. We are not the publisher or speaker of user content and have no obligation to pre-screen, monitor, or remove content, though we reserve the right to do so. To the extent permitted by applicable law, including 47 U.S.C. § 230, we are not liable for any user-generated content.

You retain ownership of all content you upload. By posting content on Tenebr, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, display, reproduce, adapt, and distribute that content solely for the purpose of operating and improving the service. This licence terminates when you delete the content or your account, except where copies have been made in the course of moderation, legal compliance, or backup processes. You represent and warrant that you own or have all necessary rights to the content you upload, that it does not infringe any third-party intellectual property rights, and that you have obtained any necessary consents from individuals depicted in your photos.

5. Location data

If you grant location permission, we collect GPS coordinates solely to calculate distances between you and other users and events. We store only your most recent coordinates. Other users see a rounded distance — never your precise location. You may withdraw location permission at any time in your device settings or by removing your location in the app. Coordinates are permanently deleted when your account is deleted.

6. Advertising and behavioural tracking

Tenebr shows sponsored profile cards in the discovery feed. When you interact with a sponsored card, we log the event type (impression, swipe right, swipe left, or message open). Advertisers receive only anonymous aggregate statistics broken down by gender, age range, and subculture interest. Your name, username, photos, and any personally identifying information are never shared with advertisers. You may opt out of ad interaction tracking at any time in Settings → Privacy → Ad Personalisation.

7. Verified status

The Verified badge (★) is awarded at our sole discretion to notable members of the gothic and dark-alternative community. It is not a general identity verification and does not constitute an endorsement of the recipient's work, character, or views. Verified status is not purchasable, is non-transferable, and may be revoked at any time without notice or liability.

8. Events

Events listed on Tenebr are curated by our team but organised and operated by independent third parties. Tenebr is not responsible for any aspect of a third-party event, including without limitation its safety, organisation, cancellation, ticket fulfilment, or the conduct of organisers or attendees. We make reasonable efforts to publish accurate information but do not warrant the accuracy, completeness, or timeliness of event listings. Attending an event listed on Tenebr is entirely at your own risk.

9. Third-party services and links

The service may contain links to third-party websites, apps, or services. We do not control and are not responsible for the content, privacy practices, or terms of any third party. Links do not imply our endorsement. Your interactions with third parties are solely between you and them.

10. No guarantee of outcomes

Tenebr facilitates introductions between users. We do not guarantee matches, conversations, relationships, or any other outcome. We make no representation about the accuracy, honesty, identity, intentions, or character of other users. Meeting strangers from the internet carries inherent risk. Always meet in a public place, inform a trusted person of your plans, and trust your instincts. Tenebr bears no liability for any harm arising from your interactions with other users, whether online or in person.

11. Paid features and subscriptions

Tenebr may offer premium features, subscriptions, boosts, or other paid services (“Paid Features”). Where Paid Features are available:

12. DMCA and intellectual property

We respect intellectual property rights. If you believe content on Tenebr infringes your copyright, send a notice to legal@tenebr.app containing: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the service; (c) your contact information; (d) a statement of good faith belief that the use is not authorised; and (e) a statement, under penalty of perjury, that the information is accurate and you are the rights owner or authorised to act on their behalf. We will respond to valid notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws. Repeat infringers will have their accounts terminated.

13. Content moderation and termination

We may — but are not obligated to — monitor, remove, or restrict access to any content at our sole discretion and without notice. We may suspend or permanently terminate any account at any time for any reason, including but not limited to a breach of these Terms, conduct we deem harmful to users or the platform, or inactivity. You may appeal a suspension by emailing safety@tenebr.app; our decision on appeal is final. Account termination does not entitle you to any refund of Paid Features. In cases involving illegal content, we may report to law enforcement without prior notice to you.

14. Account deletion and data retention

You may delete your account at any time in Settings. Upon deletion, your profile is immediately removed from the discovery feed and your account enters a 30-day grace period during which you may reactivate it by signing in. After 30 days, all personal data is permanently and irreversibly deleted. Moderation records, reports, and blocks may be retained for up to 12 months for safety and legal compliance purposes. Transaction records are retained as required by applicable law.

15. Advertiser accounts

If you access the advertiser portal, you represent and warrant that all campaign content complies with applicable advertising law and regulations in every territory where your campaign runs. You are solely liable for your campaign content and any claims arising from it. We reserve the right to reject or remove any campaign at our sole discretion and without liability.

16. Modifications and discontinuation

We reserve the right to modify, suspend, or discontinue the service — or any part of it — at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service. If we permanently discontinue the service, we will provide reasonable advance notice where practicable.

17. Disclaimer of warranties

To the fullest extent permitted by applicable law, the service is provided “as is” and “as available” without warranty of any kind, express or implied. We expressly disclaim all warranties including, without limitation: (a) implied warranties of merchantability, fitness for a particular purpose, and non-infringement; (b) any warranty that the service will be uninterrupted, error-free, secure, or free of viruses or harmful components; (c) any warranty as to the accuracy, completeness, or reliability of any content on the service; and (d) any warranty regarding the identity, honesty, intentions, or conduct of other users. You use the service entirely at your own risk.

18. Limitation of liability

To the fullest extent permitted by applicable law, Tenebr and its operators, directors, employees, agents, licensors, and service providers shall not be liable for:

Our total aggregate liability to you for all claims arising under or relating to these Terms or the service, regardless of the theory of liability, shall not exceed the greater of: (a) $100 USD, or (b) the total amount you have paid to Tenebr in the twelve months immediately preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless Tenebr and its operators, directors, officers, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgements, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right, privacy right, or publicity right; (d) any content you upload, post, or transmit through the service; (e) your interactions with other users; or (f) any claim that your content caused harm to a third party. This indemnification obligation survives termination of your account and these Terms.

20. Dispute resolution and binding arbitration

Please read this section carefully. It affects your legal rights.

Except for claims that qualify for small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the service — including questions about their existence, validity, or termination — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted in Los Angeles, California, or via videoconference at either party's election. The arbitrator's award shall be final and binding and may be entered as a judgement in any court of competent jurisdiction.

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

Opt-out: You may opt out of this arbitration agreement by sending a written notice to legal@tenebr.app within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in accordance with Section 22 (Governing Law).

21. Class action waiver

To the fullest extent permitted by law, you and Tenebr each waive the right to bring or participate in any class action, collective action, or representative proceeding. All claims must be brought on an individual basis only. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim must be severed from arbitration and brought in court, while all other claims remain subject to arbitration.

22. Governing law and venue

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. For any claim not subject to arbitration, you consent to the exclusive personal jurisdiction of the state and federal courts located in Los Angeles County, California. This does not limit any non-waivable rights you may hold under the consumer protection law of your country of residence.

23. Force majeure

We will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental action, internet or telecommunications failures, or third-party service outages.

We may update these Terms at any time. When we do, we will post the revised version here with an updated effective date. For material changes, we will provide at least 14 days’ notice via in-app notification or email. Your continued use of the service after the effective date constitutes acceptance of the revised Terms. If you do not agree with a change, your only remedy is to stop using the service and delete your account.

Community Guidelines

Tenebr is a dating app for people in and around the goth, post-punk, industrial, and dark alternative scenes. Our guidelines exist to make sure everyone here feels safe enough to be themselves.

I. Be real

Use your own photos from the last two years. No stock photos, no AI-generated faces of yourself, no photos of other people. If a photo includes someone else, get their consent first.

II. Be honest

Your profile should describe you, not the person you think will match best. Lying about your age, gender, orientation, or relationship status breaks trust and violates these guidelines.

III. Be respectful

Harassment, hate speech, slurs, misgendering, unsolicited explicit messages or photos, and threats of violence all result in immediate removal.

IV. No minors

18+ only. No discussion of minors in a sexual context under any circumstances. This is a hard line and reports are escalated to law enforcement.

V. No hate

No content promoting hatred, discrimination, or violence against people based on race, nationality, ethnic background, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic. Zero tolerance for Nazis, fascist imagery, or racial/national-origin discrimination — no exceptions, no irony, no “just asking questions.” Violations trigger an immediate permanent ban.

VI. No spam or scams

Tenebr is for finding connection. Mentioning your work, your art, or your shop is fine — we’re not going to police someone saying they make jewellery. What’s not fine: multi-level marketing pipelines, cryptocurrency recruiting, phishing or scam links, chain referrals, or using the DM system as a mass-marketing channel. Sex work and OnlyFans promotion are also outside the scope of this platform.

VII. No catfishing

Do not pretend to be someone else or use photos that do not show your current self.

VIII. No AI-generated you

AI-generated or heavily-manipulated photos of yourself are not allowed. Cosmetic edits (lighting, colour) are fine. Creating a face that isn’t yours is not.

IX. Safe meetings

Meet in public. Tell a friend. Trust your instincts. If someone makes you uncomfortable, block and report them — we take every report seriously.

What happens if you break a rule

Minor violations: we may warn you and remove the offending content. Repeat or severe violations: permanent ban. Illegal content: permanent ban and we may report you to law enforcement.
